By accessing or using Quail Keeper Max at quailkeepermax.com (the "Service"), operated by 2B Creations ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
Quail Keeper Max is a web-based quail farm management platform that provides tools for flock management, egg production tracking, health records, financial tracking, breeding program management, and AI-powered farming advice through Captain Coturnix. The Service is provided on a subscription basis with different plan tiers.
To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old to create an account. You agree to notify us immediately of any unauthorized use of your account.
New accounts receive a 14-day free trial with access to all features. No credit card is required to start a trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service. If you do not subscribe, your account will be limited but your data will be retained.
Paid subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. Subscription fees are non-refundable except where required by law.
We reserve the right to change subscription pricing with 30 days' notice. Price changes will take effect at the start of your next billing cycle after the notice period.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until your current period expires.
You agree not to:
Use the Service for any unlawful purpose or in violation of any applicable laws; attempt to gain unauthorized access to the Service or other users' accounts; interfere with or disrupt the Service or its infrastructure; upload malicious code, viruses, or harmful content; use the Service to send spam or unsolicited communications; resell, sublicense, or redistribute access to the Service without our written consent; or use automated tools to scrape or extract data from the Service.
You retain ownership of all data you enter into the Service, including flock information, egg records, health records, financial data, and breeding records. We do not claim ownership of your content.
By using the Service, you grant us a limited license to process, store, and display your data solely for the purpose of providing the Service to you, including processing your data through Captain Coturnix AI to provide personalized advice.
Captain Coturnix is an AI assistant that provides farming advice based on your flock data. While we strive for accuracy, AI-generated advice is for informational purposes only and should not be considered a substitute for professional veterinary, agricultural, or financial advice.
We are not liable for any decisions you make based on Captain Coturnix's recommendations. Always consult qualified professionals for critical health, breeding, or business decisions.
We strive to keep the Service available 24/7 but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from Service downtime.
To the maximum extent permitted by law, 2B Creations and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or uninterrupted.
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. We may provide you an opportunity to export your data before deletion, but are not obligated to do so in cases of Terms violations.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Texas.
